1. About these terms
These terms apply to every game published by Glowbox Games, a business name of Luminary Group Aus Pty Ltd (ABN 65 668 790 814) ("we", "us"), and to glowboxgames.com. By downloading or playing one of our games, you agree to these terms and to our privacy policy. If you don't agree, please don't use our games.
2. Who can play
Anyone can enjoy our games, but if you're under 18 you need a parent or guardian's permission to make purchases, and they should read these terms with you.
3. Your licence to play
We give you a personal, non-exclusive, non-transferable licence to download and play our games on devices you own or control, for your own non-commercial entertainment. The games, including their code, art, characters, music, names and logos, belong to us or our licensors. You may share screenshots and videos of your play, including on streaming and video sites, as long as you don't suggest we endorse you.
4. In-game items and currencies
Our games include virtual items and currencies such as gems, medals, cash, fuel, skip tickets and cosmetic looks ("virtual items").
- Virtual items are a licence to use content inside the game. You don't own them, and they have no value outside the game.
- They can't be exchanged for real money, sold, or transferred to another person or game.
- Consumable items, like gems, are used up when you spend them.
- We may adjust prices, rewards and how items work to keep a game fair and fun. We won't take away items you've paid for without good reason, such as a refund, fraud or a serious breach of these terms.
5. Purchases and refunds
All purchases are processed by Apple (App Store) or Google (Google Play) under their terms, and prices are shown in the store before you buy. Refund requests go to them. See our support page for how. One-time unlocks can be restored on a new device signed in to the same store account, using Restore purchases in the game's settings.
6. Ads
Our games show ads only when you choose to watch one for a reward. Rewards are given when an ad finishes. If an ad fails to load, you won't lose anything and can try again later. Ads are provided by third parties, and we aren't responsible for products advertised in them.
7. Playing fair
You agree not to:
- use cheats, hacks, bots, modified versions of our games, or tools that alter game data or purchases;
- deliberately exploit bugs to gain an advantage (please report them instead);
- copy, decompile, reverse engineer or resell our games, except as the law allows; or
- use our games for anything unlawful, or in a way that harms other people or our services.
If you break these rules, we may remove virtual items gained unfairly or stop supporting your use of the game.
8. Your progress
Game progress is saved on your device. Deleting a game, resetting your device or losing your device may delete your progress. Use the save-code backup in the game's settings to protect it. We'll always try to help recover progress, but we can't guarantee we can.
9. Updates and availability
We update our games to fix problems and add content, and some updates may be needed to keep playing. We may change or stop offering a game in the future. If we stop offering a game that sells items, we'll give at least 30 days' notice in the game or on this website where we reasonably can, and we'll stop selling items before it closes.
10. Australian Consumer Law
Our games come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded. Similar consumer protection laws may apply where you live.
11. Limits on our liability
To the extent the law allows, we provide our games "as is", and we aren't liable for indirect or consequential loss, or for loss of virtual items or progress that wasn't caused by us. Where our liability for failing to meet a consumer guarantee can be limited, it's limited, at our choice, to supplying the service again or paying the cost of having it supplied again. For anything else, our total liability is limited to the amount you paid us in the 12 months before the claim.
12. Apple App Store
If you downloaded a game from the App Store, Apple's standard Licensed Application End User License Agreement also applies. These terms are between you and us, not Apple. Apple isn't responsible for the game or its content, has no obligation to provide support for it, and is a third-party beneficiary of these terms who may enforce them against you.
13. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the courts of New South Wales, but you can also bring a claim in your local courts if your local law gives you that right.
14. Changes to these terms
We may update these terms from time to time. We'll change the "last updated" date above, and for important changes we'll also let you know in the game. If you keep playing after a change, the new terms apply.
